Terms of Service

These terms are an agreement between you and Dominic Eburuoh, trading as Billery ("Billery", "we", "us"). They apply whenever you use Billery: on the web, on your phone, through our API, or through ChatGPT and other connected apps. By creating an account or using Billery, you agree to them.
1. About Billery
Billery is built and run by Dominic Eburuoh, an independent developer based in the United Kingdom. It is not a registered company. Billery lets you create, store and send invoices, quotes and receipts, manage your customers, and do this with the help of an AI assistant.
2. Who can use Billery
Billery is for people running a business, including sole traders and freelancers. You must be at least 18. If you use Billery on behalf of a company or other organisation, you confirm that you have the authority to accept these terms for it, and "you" includes that organisation.
3. Your account
- Keep your account details accurate and up to date.
- Keep your password, API keys and connected apps secure. You are responsible for everything done through your account. This includes actions taken by apps or API keys you have authorised.
- Tell us straight away at support@billery.io if you think someone has accessed your account without permission.
4. Plans, payment and cancellation
- Free plan. Your first 3 invoices and 3 quotes are free, with every feature included.
- Pro plan. Pro costs £10 a month and includes unlimited invoices and quotes and API access. Stripe takes payment monthly in advance, and your subscription renews automatically until you cancel.
- Cancelling. You can cancel at any time from the billing section of your profile. Cancellation takes effect at the end of the month you have already paid for. We don't refund partial months unless the law requires us to.
- Price changes. We will give you at least 30 days' notice by email before a price change applies to you. You can cancel before it takes effect.
- Failed payments. If a payment fails and isn't resolved, your account may return to the free plan's limits. Your existing documents remain available.
5. Your content
You own everything you put into Billery, including your business details, customers and documents. You give us permission to host, copy, process and transmit it only as needed to run Billery for you. For example, we need to store your documents, generate PDFs, and email documents when you ask us to.
You are responsible for your content and how you use it. In particular:
- Accuracy and tax. You are responsible for the accuracy of your documents and for meeting your tax and invoicing obligations, including VAT. Billery is not accounting, tax or legal advice.
- Your customers' data. You must have the right to add your customers' details to Billery and to send them documents. Our Privacy Policy explains how we handle that information on your behalf.
6. The AI assistant
The assistant uses AI to turn your requests into customers and documents. AI can make mistakes. It might misread an amount, choose the wrong customer or word something poorly. Everything the assistant creates is saved as a draft. You must check it before you send it, and you are responsible for what you send.
7. ChatGPT, connected apps and the API
- You can connect Billery to ChatGPT and other apps that support the Model Context Protocol. A connected app can act on your Billery account only within the access you approve. That includes creating documents and sending them to your customers when you ask it to.
- Your use of ChatGPT or any other connected app is also governed by that app's own terms. We are not responsible for how a third-party app behaves or what it does with information it receives.
- If you use our API, keep your keys secret and stay within the published rate limits. Don't use the API to build a service that competes with Billery by reselling its core features.
8. Acceptable use
You must not use Billery to:
- create false, misleading or fraudulent invoices, quotes or receipts, or invoice anyone for goods or services they didn't agree to
- send spam, phishing or unsolicited bulk email
- break the law or infringe anyone else's rights
- upload malware, or try to access other users' data or bypass security or usage limits
- overload, disrupt, scrape or reverse-engineer the service
We may remove content or suspend accounts that break these rules. Where it's reasonable to do so, we will tell you why first.
9. Availability and changes
We work hard to keep Billery available and reliable, but we can't promise it will always be uninterrupted or error-free. We may change, add or remove features over time. If we remove something significant that you pay for, we will tell you in advance.
10. Liability
Nothing in these terms limits liability that cannot legally be limited, including liability for death or personal injury caused by negligence, or for fraud.
Subject to that:
- We are not liable for loss of profit, revenue, business, goodwill or data, or for any indirect or consequential loss.
- We are not liable for unpaid invoices, tax penalties, or losses caused by errors in documents that you sent.
- Our total liability to you in any 12-month period is limited to the greater of the fees you paid us in that period or £100.
Billery is provided for business use. If you are nevertheless a consumer, you keep any rights that consumer law gives you and that cannot be excluded.
11. Ending your use of Billery
You can stop using Billery at any time. To close your account and have your data deleted, email support@billery.io from the address on your account. Before you do, download any documents you need to keep for your records. We may suspend or close your account if you seriously or repeatedly break these terms, or if we have to for legal reasons. If we close Billery entirely, we will give you at least 30 days' notice so you can export your documents.
12. Changes to these terms
We may update these terms from time to time. If a change materially affects you, we will tell you by email or in the app at least 30 days before it takes effect. If you keep using Billery after that, the new terms apply. If you don't agree, you can cancel before they take effect.
13. Governing law
These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute, although if you are a consumer living elsewhere in the UK, you may also bring proceedings in your local courts.
